  1. 1. Who May Enter
    NO PURCHASE IS NECESSARY AND A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
    Contest is open to everyone (excluding residents of Puerto Rico) twenty-one (21) years of age or more at the time of entry. Employees of InterContinental Hotels Group PLC, NGTI, Limited and National Geographic Society and each of their subsidiaries and affiliated companies, and immediate family members of such employees (defined for the purpose of these rules as husband, wife, mother, father, sister, brother, son, daughter, or persons residing in the same household of such employees) are not eligible. Professional photographers may not enter. Professional photographers are defined for this purpose as individuals who derive more than 10% of their annual gross income from the sale of photographs and/or provision of photographic services. CONTEST IS VOID IN PUERTO RICO AND WHERE PROHIBITED. The Sponsors reserve the right to verify the eligibility of entrants and check their identity.
  2. 2. The 'Sponsors' of the Contest are InterContinental Hotels Group PLC of 67 Alma Road, Windsor, Berkshire SL4 3HD, UK and NGTI Limited of Shepherds Building East, Richmond Way, Shepherds Bush, London W14 0DQ and National Geographic Society, 1145 17th St., N.W., Washington, D.C. 20036.
  3. 3. Term: The Insights Photo Contest (the "Contest") begins March 21, 2007 at midnight (12:00am) Eastern Time and ends July 1, 2007 at midnight (12:00am) Eastern Time. Online entries must be received by July 1, 2007 at midnight Eastern Time. Mailed entries must be received by July 1, 2007.
  4. 4. Entry Requirements: Submit one color photograph that reveals your personal understanding of a special place or destination anywhere in the world (the "Photograph"). The Photograph should be compelling enough to make us want to go there. Only one photograph may be submitted by each entrant, regardless of method of entry. Entries must comply with all Entry Requirements as follows:
    • - The Photograph must have been taken within five (5) years prior to the end of the Contest term.
    • - The Photograph, in its entirety, must be a single work of original material taken by the contest entrant. By entering the Contest, entrant represents, acknowledges and warrants that the submitted Photograph is an original work created solely by the entrant and that no other party has any right, title, claim or interest in the Photograph; nor does the Photograph substantially take from or colorably imitate the work of someone else.
    • - Obscene, provocative, or otherwise objectionable content will not be considered, and such determination is solely at the discretion of Sponsor.
    • - A photograph that has already won any prize or distinction in another competition will not be eligible for entry. Any photograph that has been published or sold commercially (whether directly or via an agency intermediary) will also not be eligible.
    • - You must be prepared to provide Sponsors with the original high resolution capture as it was recorded by the camera with no manipulation applied (e.g., *DNG, *NEF, *JPG, *CR2, *CRW). Failure to provide such a file on request may result in disqualification.
    • - You may crop the Photograph before submission. The actual representation of a natural form, image or phenomenon must be maintained. Altering the Photograph in any way using Photoshop techniques, multiple exposures, compositing is not permitted.
  5. 5. How to Enter:
    You may submit your entry either digitally or in the form of a print.

    To submit a digital entry:
    • - Images should be saved at a suggested 8" x 10" vertical or 10" x 8" horizontal .jpg files; and must be a minimum of 72 DPI.
    • - Images must be saved as .jpg files at the highest possible quality setting (12 or Max in Photoshop).
    • - The file name/label must carry the name of the entrant and the key subject (e.g., JSmith.sunset.jpg).
    • - Complete an online entry form and follow directions for upload of your digital Photograph at www.intercontinentalinsights.com. All files must be labeled and accompanied by an entry form.
    To submit a print:
    • - Submit a color print of your Photograph, no larger than 8" x 10" and no smaller than 5" x 7". Write the name and address of the entrant on the reverse of the print, and complete an official entry form available from www.intercontinentalinsights.com.
    • - Mail the print and completed entry form in one envelope with sufficient postage to:

    • - Submitted prints will not be returned.
  6. 6. Third Party Licenses Upon Sponsors' request, each entrant must be prepared to provide a signed written personal release from all persons who appear in the Photograph submitted, authorizing each of the Sponsors (and their licensees, designees and affiliated companies) (collectively, the "Authorized Parties") to use, reproduce and distribute the Photograph in any media now or hereafter known, without restriction, including commercially using and exploiting it to fullest extent possible. Similarly, upon Sponsor's request, each entrant must be prepared to provide a signed written release from the copyright owner of any sculpture, artwork or other copyrighted material that appears in the Photograph entry, granting the Authorized Parties a non-exclusive, royalty-free, irrevocable license to use, reproduce and distribute the Photograph in any media now or hereafter known, without restriction, including commercially using and exploiting it to fullest extent possible. Finally, upon Sponsor's request, each entrant must be prepared to provide a signed written release from the owner of any well-known trademark that appears in the Photograph entry, granting the Authorized Parties a right and license to use and reproduce the Photograph in any media now or hereafter known, without restriction, including commercially using and exploiting it to fullest extent possible. All releases must be in the form provided by Sponsors. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.
  7. 7. Entrants' Licenses: Each entrant grants to the Authorized Parties a non-exclusive, royalty-free license through the entire world and for the duration of intellectual property rights pertaining thereto, to use and reproduce, in whole or in part, without any number limitation, in any form, by any mean or process, or any medium, whether now known or hereafter existing, the Photograph for editorial, commercial, advertising, promotional, publicity or trade purposes, including commercially using and exploiting it to fullest extent possible. Each winner further acknowledges that any Authorized Party may use a name credit in connection with such use, in any media now or hereafter known. No Authorized Party will be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation.
  8. 8. Judging:
    Contest consists of two (2) rounds of evaluation. The judges will evaluate the entries based on the following criteria ("Judging Criteria") weighted equally:
    1. (1) Extent to which the Photograph captures the essence of a place
    2. (2) A new perspective on a photographic subject
    3. (3) Composition
    4. (4) Clarity and technical quality
    5. (5) Creativity
    The judges in the first round shall consist of three experts in the field of photography (at least one of whom shall be independent of the Sponsors) and will be appointed by the Sponsors to identify fifty (50) finalists, using the Judging Criteria. The judges in the second round shall consist of three different experts in the field of photography (at least one of whom shall be independent of the Sponsors) and will be appointed by the Sponsors to choose the winners from among the finalists, using the Judging Criteria. The names of the judges will be provided on request. The Sponsors' decision on all matters (including the eligibility of entrants and entries) relating to the Contest is final other than the choosing of the winner and the runners-up, which shall be decided by the judges, and no correspondence will be entered into concerning the Contest's judging and organization. Sponsor reserves the right not to award all prizes in the event an insufficient number of eligible entries meeting the minimum judging criteria are received, as determined by Sponsor and judges in their sole discretion.
  9. 9. Prizes:
    THE POTENTIAL WINNERS ARE REQUIRED TO SIGN THE FOLLOWING: (1) AN AFFIDAVIT OF ELIGIBILITY AND LIABILITY RELEASE AND (2) WARRANTY OF OWNERSHIP AND LICENSE. UNLESS PROHIBITED BY LAW, EACH POTENTIAL WINNER MUST SIGN THESE TWO DOCUMENTS IN ORDER FOR SPONSORS TO AWARD THE PRIZE. NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE WILL RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATE WINNER.

    The Grand prizewinner of the Contest will receive a National Geographic Expedition to Australia for two persons in 2008. Covered expenses are roundtrip coach air travel for the winner and a guest of his/her choice from the major airport closest to winner's home to and from the Expedition; 16 days and 15 nights hotel accommodation and select meals during the Expedition (Expedition goes to Kangaroo Island, Tasmania, and the Great Barrier Reef); and a one or two day (at Sponsor's discretion) tour of Sydney (including overnight stay) with a National Geographic photojournalist, solely for Grand prizewinner and his/her guest. All other expenses are the responsibility of the Grand prizewinner. Prize trip must be taken at the time the tour is offered in 2008. Travel companion should be a suggested eighteen (18) years or older. If the winner cannot travel at that time, the winner may be disqualified and an alternate winner selected. Sponsors reserve the right to substitute the prize, in which case a prize of equal or greater value will be awarded. Approximate Retail Value (ARV) of the Grand Prize is $38,000 US based on a departure example. Actual value may vary from ARV, based on location of winner's residence and other variables. Any difference between actual value and ARV will not be awarded.

    The second place prizewinner will be awarded two (2) consecutive nights at any InterContinental Hotel & Resort worldwide, double occupancy; and a Sony DSC-H5/B digital SLR camera. ARV of second prize is $1,000 US based on location example. Hotel stay is based on availability; blackouts and restrictions may apply. No airfare, travel, hotel taxes or incidentals included. Hotel stay must be redeemed by September 30, 2008.

    The third place prizewinner will be awarded two (2) consecutive nights at any InterContinental Hotel & Resort worldwide, double occupancy; and a National Geographic World Atlas book. ARV of third prize is $650 US based on location example. Hotel stay is based on availability; blackouts and restrictions may apply. No airfare, travel, hotel taxes or incidentals included. Hotel stay must be redeemed by September 30, 2008.

    Prizes are not transferable and may not be substituted by the prizewinners or redeemed for cash.
  10. 10. Notification: The winners will be notified on or about July 17, 2007. If the chosen winner is not available to participate in the prize of the Expedition, the judges reserve the right to award that prize to a second- or third-place winner. Entries will not be returned. The names (and country and county of residence of the winner and the runners-up) may be published in the October issues of National Geographic Magazine and National Geographic Traveler Magazine and may appear in features to be broadcast on National Geographic Channel. The winners are deemed to have consented to such publication and broadcast and to publication and broadcast elsewhere for the purposes of the Contest and other post-event publicity.
  11. 11. Liability: All entries are sent at the entrant's risk. The Sponsors are not responsible (either jointly or severally) for lost, late, damaged, illegible, stolen, misdirected, misidentified, postage due or incomplete entries, for any problems or technical or mechanical malfunction of any telephone systems, computer on-line systems, servers, access providers, computer equipment, software, failure of any entry to be received by the Sponsors on account of technical problems or traffic congestion on the Internet or at any website, or inaccurate entry information, whether caused by equipment, programming used in this Contest, human processing or otherwise, or any combination thereof. The Sponsors are not responsible (jointly or severally) for any costs associated with claiming any prize. The winners are solely responsible for the payment of any and all taxes, if any, that may result in claiming a prize in this Contest. Sponsors will issue IRS Form 1099s or other tax documents to prizewinners as appropriate.

    By participating, participants agree to release, discharge and hold harmless Sponsors and their partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.
  12. 12. RIGHT TO CANCEL OR SUSPEND CONTEST
    If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsors elect to cancel or terminate the Contest, Sponsors will not retain any rights in the submitted Photographs.
  13. 13. General Agreement: Submission of an entry to the Competition automatically constitutes the entrant's acceptance of all the Terms and Conditions set forth in the above rules. Entrants not complying in full with the above Terms and Conditions will be disqualified. Entries that are incomplete, defaced or damaged will be disqualified. Odds of winning depend on number and caliber of entries received.
  14. 14. WINNERS LIST
    Winners' names will be available online at www.intercontinentalinsights.com after July 31, 2007.

    NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST: Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by National Geographic to mail skill contests or sweepstakes. To elect to have an individual's name excluded from all such lists, submit a removal request in writing to: National Geographic Society, Registration Sweepstakes, Attention: Advertising Division, National Geographic Traveler, 1145 17th Street, NW, Washington, DC 20036-4688. This notification system may be used to prohibit mailing of all skill contests or sweepstakes by National Geographic to such individual.
